N-of-One does not, direct or indirectly, through the Website or any other means, practice medicine, render medical advice, or provide medical services. The information provided on the Website (the “Information”) is presented for the purpose of providing general information on N-of-One and also for the education of the visitor regarding leading-edge cancer genomics, molecular diagnostics, personalized cancer care and genomic research. N-of-One uses a variety of third party sources in providing Information on the Website. No Information on the Website should be taken to be or relied on as the practice of medicine, medical advice, instruction for medical diagnosis, instruction for treatment or for decision making with respect to any other professional or healthcare matter. You should always consult a physician or other qualified healthcare provider before making healthcare decisions. N-of-One® Privacy Policy

N-of-One understands that information exchanged within the Website between you and N-of-One is potentially private, and it is very important to us that you make informed decisions about how such information and the Website are used. Thus, we hope you will take a few minutes to read about how we protect the information you share.

N-of-One’s Privacy Policy is designed to help you understand not only how we treat and protect the information you submit to or create on the N-of-One Site, but also how N-of-One generally protects your privacy, personal and protected health information (“PHI”). The Privacy Policy covers N-of-One’s treatment of your information, including PHI, that N-of-One gathers when you are accessing the Website and when you use N-of-One services. It does not cover the content or privacy policies of companies or third parties to which our Website is linked. You should carefully review the privacy policies of any websites you visit.

We cannot guarantee the security of any e-mails sent to N-of-One: while we meet or exceed the legal requirements for security of PHI received by N-of-One, we cannot guarantee that your e-mail is not intercepted in transit or the security of your networks and Internet Service Provider. If your communications contain sensitive information or PHI, N-of-One suggests that all such information is encrypted to the highest level available to you. In the alternative, you may wish to use your relevant government approved mail services. N-of-One will not forward your mail outside of the company and nor will your name and email address be used for any purpose other than to respond to your query.

N-of-One obtains personally identifying information about you through the Website only if you volunteer such information by e-mail or comment to N-of-One.

The Website may automatically log visitors, IP addresses, browser types, cookies information and other information to improve our Website responsiveness and IT optimization purposes. Any session may be tracked, but we do not link sessions or IP addresses to any personal information. Additionally, pages visited, length of visit and similar statistical non-personal information may be aggregated and shared with partners to show how visitors use the Website.

We receive and store any information you enter on our Website or provide to us in any other way. As part of your use of the Website, we may collect health and medical information, comments and other information, including information that might constitute PHI, that you upload, post or create yourself. Forms and e-mail links on “contact” pages and possibly other areas of the Website may be used to establish contact with users or allow users to contact us directly for any purpose. Any PHI that a user provides may be aggregated and used in a de-identified (anonymized) form. Such de-identified data may be used for informing third parties afflicted by cancer, physicians and researchers about the potential utility of individualized diagnostic and molecular testing results in guiding treatment strategies. Notwithstanding the foregoing, your PHI will be used by N-of-One only as specified in the N-of-One Notice of Privacy Practices Consent Form as detailed below.

Information (of any type or form) that you transmit to our Website, by filling in a form on the Website or directly sending us an e-mail, will to the extent of applicable laws, be treated as non-confidential and nonproprietary information. The personal information or PHI you voluntarily provide us will not, unless de-identified and aggregated, be sold, disclosed, distributed to any third party unless mandated by law or through your permission. By providing us with such information or PHI, you agree to the foregoing. If N-of-One is required to disclose such by operation of law, or to effect the services requested by you, N-of-One will only disclose the minimum data set required to achieve those goals.

You should not communicate any PHI prior to entering into an agreement with N-of-One for services.

Our Website may provide links to other websites maintained by third parties. These links are provided solely as a courtesy to users of the Website and when navigating away from the Website, you will become subject to the terms and conditions of use of the new websites to which you may be directed. N-of-One disclaims all responsibility for the content, policies, security and other procedures and practices followed by such third party websites.

Cookies are alphanumeric identifiers that we may transfer to your computer’s hard drive through your browser to enable our systems to recognize your browser and tell us how and when pages on the Website are visited and by how many people.

Certain pages on the Website may employ cookies. N-of-One cookies do not collect personal information, and we do not combine the general information collected through cookies with other personal information to tell us any of your identity, screen name or email address.

Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. Some browsers can be instructed to delete all cookies at the end of each browsing session. N-of-One suggests that the user consult an information technology specialist to determine the correct settings for each individual user.

HIPAA Compliance
The following Notice of Privacy Practices is provided pursuant to Health Information Technology for Economic and Clinical Health Act (HITECH Act) and the Genetic Information Nondiscrimination Act (GINA).



This Notice describes the privacy practices of N-of-One Inc. (“N-of-One”). This Notice applies to uses and disclosures of protected client medical information collected by N-of-One — which is legally required to provide this Notice.

N-of-One may change this policy at any time and without prior notice. Those changes will apply to any protected health information (“PHI”) already held by N-of-One. N-of-One will keep the current policy on the website and available at its offices.

Uses and Disclosures
N-of-One may collect PHI for use as described herein. The information will be used and disclosed in providing N-of-One services (the “Services”). N-of-One will handle your PHI in accordance with the Health Insurance Portability and Accountability Act (“HIPAA”) and all related federal and state rules and regulations, as well as the provisions of this Notice.

N-of-One may disclose your PHI to N-of-One service providers who will use the information to process your case and other individuals who are involved in providing Services. In some cases your PHI or de-identified PHI may be sent to an outside consulting physician or other consulting medical professionals in order to facilitate the Services. Additionally, a client officer may share your PHI with our medical director in order to identify an appropriate consulting physician for your case. In other cases your PHI may be shared to facilitate payment as appropriate for reimbursable actions. The client officer may share the PHI with your physician. We will require consultants who have access to your PHI to sign agreements requiring them to preserve the confidentiality of this information unless consultants are already Business Associates of N-of-One.

N-of-One also may use your PHI to evaluate the performance of our Services.

N-of-One may also keep, use or share de-identified PHI based upon information you have provided to us. De-identified PHI is information that does not include your name, address, birth date, or other information that could be used to identify you. This de-identified PHI could be used for understanding trends in diagnostics, reference and research or commercial purposes. For example, N-of-One could use this de-identified information to demonstrate the reliability of our information management systems or to generate medical research information. We would not identify you by name in any resulting reports or other information.

N-of-One may disclose information in order to contact you during the course of providing services to you as either part of the ongoing process or as part of an effort to follow-up with you after using the Service. We may contact you through the mail, over e-mail or through the phone.

N-of-One may disclose your PHI for the following purposes without your authorization: (i) as required by law; (ii) for public health activities; (iii) to protect victims of abuse, neglect or domestic violence; (iv) for health oversight agencies carried out by government agencies; (v) for judicial and administrative proceedings after proper legal process; and (vi) for law enforcement purposes.

Other uses or disclosures about your PHI may require your written authorization, for example marketing or testimonial purposes. The patient can revoke that authorization at any time but that revocation will not affect any use or disclosure made prior to revocation.

N-of-One may disclose your PHI to you, to your representative or to another individual designated by you.

Individual’s Rights
You have the right to inspect, copy, restrict access to and amend your PHI maintained by N-of-One. To inspect your medical records or PHI, please make a signed and dated written request to N-of-One, Privacy Officer at the Address above. In some cases we may not honor your requests, such as if disclosing records will cause you harm, if they are part of legal proceedings or if they are part of ongoing research. In the event that we deny your request you will be notified of any denial within 60 days and be given additional options or information. To make an amendment to your PHI, please make a signed and dated written request to N-of-One, Privacy Officer at the Address above. In the request please describe the changes that you would like to make and the reason why. In the event that we deny your request you will be notified of any denial within 60 days and be given additional options or information.

You have the right to request restricted disclosures or uses or to request that we limit access to your PHI. Please make a signed and dated written request to N-of-One, Privacy Officer at the address above. Please include all of the specific information that you want to have restricted and the person or categories of persons who should or should not have access to the information. We have the right to deny your requests, to the extent required by law, or ask for additional information. In the event that we deny your request you will be notified of any denial within 60 days.

You have the right to an accounting of certain disclosures of your PHI that were made without your written authorization. Please make a signed and dated written request to N-of-One, Privacy Officer at the Address above. We are only obligated to share disclosure accounting for the proceeding six years. This accounting will include disclosures made in the course of providing the Services.

You have the right to request to receive confidential communications about your PHI, such as having information sent to a particular address or in a particular way. Please make a signed and dated written request to N-of-One, Privacy Officer at the Address above. In your request specify how you would like to be communicated with.

You have the right to make complaints about any possible violation to your Privacy Rights (as defined by state or federal law) to N-of-One. N-of-One will not penalize you for making a complaint. To make a complaint to N-of-One, please make a signed and dated written complaint to N-of-One, Privacy Officer, at the Address above. You may contact the Department of Health and Human services if you believe your privacy rights have been violated.
